#Dispute-Resolution

arbitration

Arbitration is the ritual of weighing each party's grievances on a balance while slapping on a magic label called fairness. It pretends to soothe the clash of opinions but actually satisfies no one completely and sometimes even prolongs the quarrel. Though it sounds like a legal term, in practice it's entertainment for bystanders watching a mud fight in a meeting room. By applying the same rules to the weak and the powerful, it justifies the status quo under the banner of equality.

arbitration clause

An arbitration clause is a tiny loophole designed to steer disputes away from public courts into corporate-run secret hearings. It boasts of being "quick and economical" while sacrificing transparency and guiding consumers or employees into hidden justice. Rather than ensuring fairness, it robs parties of even the freedom to choose their adjudicator with near certainty of a corporate-friendly verdict. It prepares an irreversible outcome for the loser while the user unwittingly becomes an audience member in a closed courtroom stripped of legal protection.

mediation

Mediation is a so-called high-end entertainment that grants a temporary break to warring parties. It’s lauded as a ritual of wisdom that wraps each side’s grievances in gloss while they eye each other for the perfect compromise. In reality, it’s merely a convenient device for avoiding true resolution and muddling responsibility. The moment someone declares “we’ve met halfway,” the show ends, and all real issues are fated to the next act.
